Terms of service

The terms covering your subscription, your data and payment. Draft, published before launch.

This is a draft. It has not been reviewed by a lawyer and will change before launch. It is published so you can see the terms we intend to hold ourselves to, not as a finished contract.

01The service

DiveOS is a subscription service for running a dive centre. While your subscription is active you get access to the software, every module in your plan, and the support described below.

When a subscription ends, your account becomes read-only for 30 days so you can export everything. We do not delete your data the moment a payment fails.

02The trial

The trial runs 14 days with every module available and no card required. It does not convert into a paid plan on its own — if you do nothing, it simply expires. You will not find a charge you did not agree to.

03Ownership of your data

You own everything you put into DiveOS: your guests, bookings, dive records, prices and invoices. We store and process it to run the service for you, and for nothing else. We do not sell it, and we do not use your guests’ data to train anything.

You can export it as CSV at any time, or delete it. What we collect and how it is handled is set out in the privacy policy.

04Payment and changes of plan

Plans are billed monthly or annually in advance through Stripe. We never see or store your card number.

An upgrade takes effect immediately and is prorated. A cancellation runs to the end of the period you have already paid for — we do not cut access off the day you cancel. Prices exclude VAT or GST where it applies.

05Acceptable use

Do not use DiveOS to break the law, to send your guests messages they have not asked for, or to store data you have no right to hold. Your guests’ medical information is the most sensitive thing in the system; treat your staff accounts accordingly and give people only the access their role needs.

06Availability

We aim to keep DiveOS available whenever your centre is open, and we take daily backups. We are a small, new company and we are not going to promise you an uptime figure we cannot yet prove.

If something breaks in a way that costs you a day’s diving, tell us and we will make it right on your bill. That is a commitment about our behaviour, not a liability cap negotiated by lawyers — the real clause will appear here before launch.

07Ending the agreement

You can cancel at any time from Billing in the app, with no phone call and no retention script. We may end an account for non-payment or for a breach of the acceptable-use section above, and if we do, you still get the 30-day read-only window to take your data with you.
